BarcelonaThe Provincial Court of Madrid confirmed on Friday the indictment of Alberto González Amador, partner of the Madrid regional president, Isabel Díaz Ayuso. He is being investigated for tax fraud, document forgery, ongoing accounting fraud, and membership in a criminal organization for allegedly defrauding the Spanish Treasury of nearly €351,000 in 2020 and 2021 through several false invoices. The confirmation comes after the judges dismissed the appeal filed by González Amador against the summary proceedings ruling issued by Madrid's Court of Instruction Number 19 in May. In this appeal, Ayuso's partner requested the annulment of this ruling, which was the preliminary step before the start of the trial. which the judge already opened at the end of September

Ayuso's partner requested that this step be annulled, arguing that it was being carried out "without allowing" the defense "to carry out any of the investigative procedures" it had requested, such as witness statements and an expert's ratification of a tax report. Therefore, he considered that his right to defense was being violated. At the time, the investigating judge had already indicated that the evidence González Amador was requesting was not essential to clarify the facts under investigation, and now the Madrid Provincial Court has upheld this decision. Therefore, the trial continues.

In the proceedings, the Public Prosecutor's Office and the State Attorney's Office are requesting a three-year and nine-month prison sentence for González Amador. For their part, the PSOE and Más Madrid, which are part of the case as private prosecutors, are requesting a five-year prison sentence, since in addition to the charges of tax fraud and document forgery, they are also seeking an accounting offense and membership in a criminal organization.

The relationship with the trial of the attorney general

The case began in 2022, following a complaint filed by the Public Prosecutor's Office based on a report from the Tax Agency indicating that several "fictitious expenses" had been detected. In total, the businessman and Ayuso's partner allegedly defrauded the public coffers of €350,910 in corporate tax. This is the case that has even implicated the Attorney General of Spain, Álvaro García Ortiz. Not because he is involved, but because of the suspicion that, in March of this year, he allegedly leaked the email in which González Amador's defense team contacted the Public Prosecutor's Office requesting a plea bargain and, therefore, admitting to having committed tax fraud.

This week, precisely, during García Ortiz's trial, Ayuso's partner, who is a private prosecutor, He blamed the attorney general for having "publicly killed" him. With that leak, which he directly attributes to Álvaro García Ortiz. "They've ruined my life: either I leave Spain or I commit suicide," he said emphatically in a closing statement before the court.

Más Madrid and the PSOE celebrate the decision

Once the Madrid Provincial Court's decision was made public, Manuela Bergerot, spokesperson for Más Madrid in the regional assembly, celebrated the judges' rejection of "Amador's umpteenth attempt to evade his responsibilities." Bergerot also pointed the finger at the Madrid president, asserting that Ayuso knows she "cannot win an election" with her partner "in prison." From the PSOE, the party's general secretary in the Community of Madrid and Minister for Digital Transformation, Oscar López, stated via X: "They threw a private party in the penthouse, paid for by the entire community. Everything will come to light."
