Why has Asencio been prosecuted? These are the clues the judge maintains.

BarcelonaMore details on the sex scandal involving four Real Madrid players from La Fábrica, including young Real Madrid center-back Raúl Asencio. The day after the judge decided to prosecute him, Efe news agency reports that the judge had evidence that the Real Madrid player had requested the video be sent to him despite knowing that a minor appeared in it. He had also shown it to a third person, who appears as a witness in the case.
The investigating judge maintains that Asencio asked former Real Madrid youth player Juan Rodríguez to send him the video "knowing that it had been obtained without the consent of the potential victims." Specifically, Court Number 3 of San Bartolomé de Tirajana (Gran Canaria) sees evidence that the four committed a total of three crimes: one of disclosure of secrets for capturing images of sexual content without permission, another of disclosure of secrets for having also distributed them without permission, and a third of child pornography.
The facts investigated
All of this stems from events that took place on June 15, 2023, at the Beach Club on Amadores beach, in southern Gran Canaria. There, the four footballers, who were between 20 and 21 years old at the time, met three girls with whom they spent part of the day. At one point, the 16-year-old girl and an 18-year-old girl agreed to go to a private room at the club with Ferrán Ruiz, Juan Rodríguez, and Andrés García, with whom they had consensual sex. Raúl Asencio, on the other hand, preferred to stay on the sidelines and stayed in the club's pool.
The court ruling explains that, according to the evidence collected, it was allegedly Ferrán Ruiz who began recording the sex scene without asking the girls' permission and without them knowing he was recording them. According to the same text, Ruiz then handed his cell phone to Juan Rodríguez so he could continue recording the scene from another perspective. This would have alarmed the girls, who discovered what was happening, despite not yet being sure whether they had been recorded or not. At this point, the girls left the room in search of their third friend and Raúl Asencio to explain what had happened. Before having sex, the court order emphasizes that the minor had already told the four defendants that he was 16 years old, so everyone knew his age.
After finding out that Ruiz had images of them, the girls demanded that the footballer delete all the videos he had made of them. At that point, according to the judge, the suspect admitted to having recorded five videos while they were having sex and then deleted them in their presence. However, the videos were not completely deleted, and by the end of the day, Ferrán Ruiz, Juan Rodríguez, and Andrés García had access to the images again. They then allegedly shared them through three social media groups. In one of these conversations, Rodríguez allegedly said that he didn't care ("it didn't matter to him").I don't give a damn", the text message read) that one of the victims was a minor.
Raúl Asencio comes back into play almost a week later, on June 21. According to the judge, that day the center back had asked Rodríguez to send him one of the videos that he knew the images were recorded without permission. a minor appeared in it. The Real Madrid defender saw it and showed it to a third party, something that he himself acknowledges in a voice message he sent to the same person days later, according to the instructor. that, as a result of these events, the minor suffers from "post-traumatic stress disorder associated with anxiety-depressive symptoms," which diminishes her "personal, social, and academic functional capacity."
