MadridActress Elisa Mouliáa has denounced the Prosecutor's Office's decision not to charge former Sumar spokesperson Íñigo Errejón with sexual assault and to request the dismissal of the case, as reported by The Spanish And legal sources confirmed to ARA. "For a non-consensual kiss (the Rubiales case), the Prosecutor's Office came forward with strong charges," he criticized, referring to Jennifer Hermoso.

In this regard, the television personality also pointed out that in her case, there are "three counts of continuous sexual assault, with evidence already validated by the judge," criticizing the Prosecutor's Office for considering it "not sufficiently justified." She asks, "Different criteria? Equality before the law demands explanations."

The actress is requesting a three-year prison sentence for Errejón and €30,000 in compensation for "moral damages and for the harm suffered as a result of the sexual abuse, or, alternatively, whatever amount is determined during the execution phase." This November, Judge Adolfo Carretero agreed to prosecute the former deputy for an alleged sexual assault against Mouliaá at the end of September 2021. The magistrate believes there is "evidence" that there may have been acts of a sexual nature without the victim's consent and therefore proposes that the accused be prosecuted.

In the opinion of the public prosecutor, the evidence gathered in the judge's order "conforms" to the law, but "is insufficient to formulate the indictment," and therefore requests the provisional dismissal and archiving of the case. Errejón's defense also appealed the magistrate's decision to send the former political leader to trial before the Provincial Court. This court has not yet issued a ruling.

In the order, the head of Madrid's Court of Instruction Number 47 refers to three separate incidents in which the former leader of Sumar allegedly committed a crime of sexual assault, which is why the magistrate uses the plural form of the crime.
