The judge sends Íñigo Errejón to trial for the alleged sexual assault of actress Elisa Mouliaá

The magistrate refers to three incidents that occurred on the same day

BarcelonaJudge Adolfo Carretero has agreed to prosecute former MP Íñigo Errejón for an alleged sexual assault against actress Elisa Mouliaá in late September 2021. This is stated in a court order, to which Europa Press had access, issued this Friday, December 4. The magistrate believes there is evidence that there may have been acts of a sexual nature without the victim's consent and therefore proposes that the accused be sent to trial. In the order, the judge refers to three separate incidents in which the former leader of the Sumar party allegedly committed sexual assault. First, in the elevator of the friends' house where they went after Errejón's book presentation; then at that address; and finally in the taxi that took them to the actress's home. For this reason, the judge uses the plural form of "sexual assault" in the order.

Almost three months after the scandal broke, Errejón, who is resigned in October of last year Pursued by accusations of sexual harassment, psychological violence and degrading sexual behavior with various women, he defended his "innocence" when he testified as a suspect in the Madrid courts in January. While he did not deny the events for which actress Elisa Mouliaá has accused him of sexual assault, the former political leader's version is that "it was all consensual," according to legal sources who spoke to reporters outside the courthouse. Mouliaá, on the other hand, ratified the content of her complaint. "It has been very hard to relive it all again, but I have told the truth and I have great faith in justice," the complainant said in a brief statement to the media after an hour and a half of testimony.

In the ruling, the judge states that "since there are no eyewitnesses to the events and there are some hearsay witnesses and expert evidence, the main piece of evidence is the victim's statement." "Her statement is consistent in its essentials, although she does not recall secondary details" of the assault, the judge maintains. The lawyer for the journalist and actress, Alfredo Arrien, in statements to The CountryThe lawyer emphasized that the investigating judge considered his statement as fundamental evidence.

"His account managed to convince a judge that he is not exactly a champion of feminism, far from it. And if the judge believed him, it's because the circumstantial evidence and his statement were sufficient," the lawyer stated, referring to Carretero, after his controversial questioning in Mouliáa. In the leaked recording of the questioning, Carretero could be seen using a harsh and incisive tone with the actress and questioning her account and her reactions when she was with the former spokesperson for Sumar on the night of the alleged sexual assault. "It's incomprehensible that she continued seeing him after the inappropriate touching," the magistrate stated.

Be that as it may, and after thirteen months of investigations in which he took statements from Errejón himself, Mouliaá, several witnesses, and psychiatrists, the judge concludes that "no vagueness or contradictions are seen" in the actress's statement "except for that lack of reaction, which is explainable because her political bloc" was "an important politician." He also maintains that Mouliaá "had no ulterior motive, enmity, hatred, or desire for revenge" against Errejón, "but rather quite the opposite," although during the questioning she asked him if he wanted something with her, and when he didn't reciprocate, she reported him. Now, the judge recalls that the leader "resigned from his post due to inappropriate conduct with women," although Errejón stated that what happened with Mouliaá had nothing to do with his time working alongside him.
