Judge Calama asks for the leakings of the Zapatero case to be investigated

The former Spanish president requests the annulment of the proceedings against him for violation of rights

MadridThe day after it was leaked José Luis Rodríguez Zapatero's private conversations and diaries, Judge José Luis Calama, the investigating judge in the Plus Ultra case at the National Court, has requested that these leaks be investigated. Calama has made the request to the investigation section of the Madrid court of instance, urging it to identify those responsible for the leaks, which he considers potentially criminal. The magistrate emphasizes that the facts have "gravity" and could fit into "criminal offenses of revealing reserved proceedings." In parallel, the former Spanish president has requested from Calama the "general nullity of the proceedings" of the case for violation of rights. According to ARA, Zapatero maintains that an "illicitly analyzed piece of evidence" has been incorporated.

The filtering of the content of the WhatsApp and Zapatero's 2024 and 2025 agendas, which include information unrelated to the investigation, is not the only one that has occurred in recent weeks. Last week the audios of Zapatero's almost three-hour statement were leaked in front of Calama, who can also be heard questioning the former socialist leader. In an order this Thursday, the magistrate complains that "from the moment the proceedings were made available to the parties involved through the Cloud platform, there have been constant and immediate leaks to the media." A behavior that reached its "maximum expression" this Wednesday with the "complete" publication of the annexes to a report by the National Police's Economic and Fiscal Crimes Unit (UDEF).

Beyond requesting that another judicial instance investigate these leaks and the possible criminal responsibilities of those who leaked them, Calama has decided to tighten access to the case documentation for the involved parties. The judge is creating a "sensitive information" section with audiovisual recordings of the statements of witnesses and investigated individuals, to which only the court leading the case and the Public Prosecutor's Office will have access. The rest of the parties will only be able to consult the transcript of the content and, if they wish to view or listen to them, they will have to do so in person at the National High Court without the possibility of taking a copy. In addition, only the PP, which has the legal representation of the popular accusations, will be able to access the Cloud from now on.

Among the popular accusations in this case are far-right parties, such as Vox, and ultra entities like Manos Limpias and Hazte Oír, which are also involved and have pushed for other investigations related to Pedro Sánchez's circle, such as that of his wife, Begoña Gómez, or his brother, David Sánchez. Yesterday's leak in the case affecting Zapatero already generated complaints from the former president's circle, who called it an "scandal" and pointed to legal actions; from Moncloa, which criticized that there are increasingly more leaks of this type, and from the PSOE, which denounced that it responded to a "witch hunt" intent.
