Consumer ratifies the fine of €3.6M to Lloguer Segur for abusive practices
The department that Pablo Bustinduy directs considers the administrative route exhausted
BarcelonaThe Ministry of Social Rights, Consumer Affairs and the 2030 Agenda has ratified the fine of 3.6 million euros that it imposed on Lloguer Segur for abusive practices against tenants after resolving the appeal filed by the real estate agency. The department headed by Pablo Bustinduy considers that this company has violated consumer rights by taking advantage of its market dominance position and has deemed the administrative route exhausted.
The sanction from Consumer Affairs determines that Lloguer Segur has committed one serious infringement and six very serious infringements. Specifically, the ministry has fined the company for requiring tenants to contract a customer service, understood as real estate management and contract formalization expenses, but also for obliging tenants to a home insurance contract for the benefit of the lessor.
Likewise, it has been fined for introducing a clause in the contract that authorizes the real estate agency to include the tenant in defaulter files in case of non-payment of any of the amounts reflected in the contract, regardless of the reason for non-payment and even if they are not due and payable debts.
The resolution also entails, in addition to the economic sanctions, accessory sanctions such as obliging the real estate agency to rectify the breaches, that is, to eliminate the identified abusive clauses. This proceeding against Lloguer Segur was initiated in March 2025 and another was opened for similar facts, which is still ongoing, after Consumer Affairs received complaints about these actions from Facua, the Tenants' Union, and the Organization of Consumers and Users (OCU).
