The prosecution does not see Errejón's actions as sexual assault and requests that the case be dismissed.

MadridThe prosecution will not charge former Sumar spokesperson Íñigo Errejón with the sexual assault he reported against actress Elisa Mouliaá and will request that the case be dismissed, according to reports. The Spanish Legal sources have confirmed this to ARA. The actress is seeking a three-year prison sentence for Errejón and €30,000 in compensation for "moral damages and for the harm suffered as a result of the sexual abuse, or, alternatively, whatever amount is determined during the execution phase." This November, Judge Adolfo Carretero agreed to prosecute the former deputy for an alleged sexual assault against Mouliaá at the end of September 2021. The magistrate believes there is "evidence" that there may have been acts of a sexual nature without the victim's consent and therefore proposes that the accused be prosecuted. In the opinion of the public prosecutor, the evidence presented in the judge's order "conforms" to the law, but "is insufficient to formulate the indictment," and therefore requests the provisional dismissal and archiving of the case. Errejón's defense also appealed the magistrate's decision to send the former political leader to trial before the Provincial Court. This court has not yet issued a ruling.

In the order, the head of Madrid's Court of Instruction Number 47 refers to three separate incidents in which the former leader of Sumar allegedly committed sexual assault, hence the magistrate's use of the plural form of the term.

Mouliaá, on the other hand, ratified the content of her complaint.

In the ruling, the judge states that "since there are no eyewitnesses to the events and there are some hearsay witnesses and expert evidence, the main piece of evidence is the victim's statement." "Her statement is consistent in its essentials, although she does not recall secondary details" of the assault, the magistrate maintains.
