The trap is made, even if the law is not!

I cannot help but explain this, so that whoever can may take advantage of it. Last March, a housing decree-law was approved which included, as we all know, the forced extension of rental contracts about to expire for a period of two years, under the same conditions. In April, this measure did not obtain the necessary support in Congress and ceased to be in force, and the government of Spain tried again with a new draft decree-law in July that, ultimately, did not go through due to the blockage by the government of Spain's partners and Junts.

The apartment of a person close to me was being rented out. This person pays a mortgage on it, but the rent is cheaper (due to price caps, they cannot raise it) and they needed to sell it. They communicated this to the tenants. And well, the tenants, being well-advised, sent them a burofax on the specific day when the law had, let's say, come out of the oven and had not yet been published in the BOE, but neither had it, yet, been struck down. They took advantage of this legal limbo to achieve, de facto, this extension that they now enjoy.

Therefore, if now, with a new decree-law, the same journey begins (and the decree is struck down again), all tenants with a contract can do as those of this person close to me did. They send a burofax on the day it is due and they already have two years of breathing room. To me, the law that gives you a two-year extension seems like a stopgap, and I am absolutely sympathetic to this person close to me who wanted to sell the apartment, and thus stop paying the difference between the mortgage and the rent. Let's say the person close to me is not a vulture fund, but rather a hippie-style fund. But I also know that housing is the main concern for all of us (who pay for it with sweat, without any tax compensation, as for example in the Basque Country) and especially for the young people coming up, who will not be able to start a family even at 40 years old because they do not have, as they say, “a place to fall dead”.
