Specifically, the Department of Justice admits that "the public prison service did not operate with the quality standards that would be required," to the point that there were "malfunctions." While this "defective" operation was not "the direct cause of the events," it accepts the "causal relationship" between the events and the assault, because "if they had not occurred, they could have led to the adoption of different measures" for the inmate, who kept his job in the kitchen despite having committed a very serious offense.
In fact, the Generalitat (Catalan government) admits that the assault against a fellow inmate should have resulted in the inmate being "immediately" suspended from work. However, in the words of the administration itself, "current regulations on prison jobs were violated" by allowing the man to return to the kitchen without having served his sentence. The inmate worked there until the day of the crime, when he also committed suicide. The Department of Justice also admits that he was allowed to return to work without following the necessary procedure, which involves the approval of the prison's multidisciplinary team and the treatment board. "The inmate's discharge from this facility was carried out without any technical validation," it summarizes. The administration has thus responded to the request for a property claim filed by Núria López's cousins, which was resolved by the advisory legal committee in a report that has been advanced. "Incorrect" use of RisCanvi
In its response to the claim, the department also admits that staffing levels at the time were "deficient" and acknowledges that improvements are needed. protocols for the use of potentially hazardous materials. The opinion of the advisory legal committee concludes that the prison administration "neglected the primary purpose of re-education and social reintegration," which constitutes "abnormal functioning" of the prison service. However, this advisory body rules out, as claimed by the victim's cousins, that the administration did not take measures to protect her after she complained about the inmate who ended up killing her, because it has not been proven that she had said anything beforehand and the attack was unexpected. For all these reasons, the committee has decided that compensation of €40,446 is appropriate, the same amount proposed by the Generalitat (Catalan government) and far from the €1.7 million the family had requested. In setting the amount, the committee took into account that, although there is no established scale for compensation to extended family members, this extended family, in this case the cousins, has traditionally been recognized as victims.
