Together froze the investigation of two complaints of "harassment" against Comín despite the resolution of the European Parliament

The party rallies around the MEP, to whom it handed over evidence presented by the alleged victims

Brussels/BarcelonaThe Junts Guarantees Commission decided on February 2 to freeze the internal investigation into two complaints it received against Toni Comín for "psychological, sexual, and physical harassment", according to an internal party report to which ARA has had access. The body has opted to shelve the two cases, for at least four months for now, despite being aware of the European Parliament's resolution upholding the complaint for psychological and sexual harassment filed in the parliamentary chamber against the former Minister of Health by a former assistant. Furthermore, as confirmed by ARA with several Junts sources, the party handed over to the MEP the complaint filed by the alleged victims and "the accompanying documentation", such as "the writings in which each of them explains the facts" and also the confidential resolution of the European Parliament.

The Junts body argues the suspension of proceedings for a "competence issue" and "considers preferential" Comín's "possible disciplinary procedure" in the European Parliament over the party's own internal investigation, which was opened on October 24, 2025. The procedure in the European Parliament, however, closed last September: it could only be reopened and the European Parliament could impose a sanction on the former Minister of Health if he obtains a seat and receives a new complaint, according to MEP sources to this newspaper.

Furthermore, regarding the other Junts advisor, she has only filed a complaint internally with the party and not with the European Parliament. In this case, several Junts sources explain to ARA that the party's employee was the victim of a physical assault by Comín during a tense moment on the night of the Catalan elections on May 12, 2024.

In the report, it is stated that the two complainants accuse Comín of carrying out a "dilatory strategy" and request that it be declared that the conflict of competence between the Guarantees Commission and the European Parliament is "non-existent"; as well as that "the instruction of the disciplinary procedure be resumed" and "precautionary measures be adopted" against the former minister. The two alleged victims also request that the "immediate resignation" of the former minister from "all his positions" be required, that "the existence of harassment conduct" be recognized, and that Comín be required to make a public apology "through a brief, sober, and direct statement, without justifications, minimizations, or exculpatory arguments".

For now, neither the Junts leadership, nor Comín, nor the complainants have wished to comment on ARA's questions.

The Guarantees Commission dismisses all requests

None of these requests have been admitted by the Guarantees Commission, led by Josep Pagès, a Junts deputy in Congress. The report admits that, at present, "the activation of the European Parliament's anti-harassment procedure is only a hypothesis" because Comín does not have a seat. However, the party body chaired by Carles Puigdemont believes that the ruling that the Court of Justice of the European Union (CJEU) must issue in the coming months may "uphold the amnesty law" and, therefore, that the former minister will end up being a full MEP. "The possibility of obtaining the seat, although hypothetical, is not entirely improbable," the text points out.

However, the Guarantees Commission itself admits that this wait "cannot be unlimited" and, therefore, sets a maximum period for freezing the internal investigation of between four and eight months. Thus, the body decided to keep it on hold for four months from when the parties received notification that the investigation was suspended, at the beginning of February, but with "the possibility of an extension".

Regarding precautionary measures, the Guarantees Commission considers that they are "not sufficiently justified" and points out that the reported conduct "has not been repeated since June 2024". Along the same lines, the report argues that "currently there is no labor, personal, or political relationship, nor any physical personal proximity", between the complainants and Comín.

Regarding the request to force his resignation and apology, the Junts body points out that "it is not the opportune procedural moment to delve into the substance of the matter subject to the disciplinary file", but rather to "rule on the competence issue of whether the possible procedure before the European Parliament should take precedence over the internal procedure or not". The Guarantees Commission responds the same way when the complainants request that the facts be "qualified as very serious" because Comín's attitude "fits the description of conduct constituting very serious offenses" according to the party's regulations, such as "attack on human rights and the dignity of individuals, and acts or endorsement of violent, insulting, or vexatious behavior".

The Junts body also does not assess that Comín, as the complainants accuse, "invokes, implicitly or explicitly, his condition as a political exile or victim as a justifying, mitigating, or exonerating element of his conduct". Finally, the report concludes by stating that the "resolution" is "not subject to appeal", for both the alleged victims and Comín.
