The judge infers that the trampling is by the deceased businessman based on a report by the Mossos that does not accredit authorship

BarcelonaThe death of Isak Andic is not a usual police and judicial investigation. And it is not so because the account of the Mossos, the prosecutor, and the judge of Martorell is built on circumstantial evidence. These indications range from the behavior of his son and sole investigated person, Jonathan Andic, in the days before the events, to the messages between father and son, the contradictions in the investigated person's statements, the analysis of the deceased's autopsy, and also the study of how the fall of the Mango founder occurred and the marks it left on the ground.

In her written statement to impose a bail of one million euros on Jonathan Andic if he did not want to enter provisional prison, the judge of Martorell indicated that technical observations show "the detail of the starting point of the fall, where a possible slip can be appreciated." "The conclusion of the Mossos Mountain Unit is that in all the conducted simulations (10 were carried out), the rubbing action of the sole of the deceased's sneakers must be done at least four times to achieve a footprint similar to the one reported on the day of the events," she states.

That is, the judge interprets, based on this report, that this footprint cannot be "fortuitous." Furthermore, in her resolution, she infers that the footprint in question belonged to Isak Andic.

The defense's argument

From the defense of Jonathan Andic, and they have put it in writing in an appeal to the Barcelona Court, they underline that there is no solid evidence that allows concluding that that footprint belonged to Isak Andic. The defense maintains that the area was not officially cordoned off or isolated and that, therefore, the evidence could have been contaminated.

In fact, defense sources also indicate some points from the report of the Mountain Unit of the Mossos, such as the one that states that "the causes that generated the fall or the participation of other people cannot be determined." They add another point in which the Mossos say that the result of the simulations was not "conclusive." Defense sources also point out that these simulations were carried out with a sole similar to the one Isak Andic was wearing and not the same one.

"It cannot be determined whether this slip was already made prior to the fall," says the police report. Police sources close to the case confirm that at no point can they conclude that the footprint belonged to Isak Andic, even though the judge infers it in her written statement. Similarly, the same sources point out that it cannot be ruled out that Jonathan Andic made it to simulate the fall, given the available evidence. For a future trial, therefore, it will be difficult to determine if the footprint belonged to the businessman. For now, the judge has authorized a reconstruction in situ of the events in Collbató, with the presence of Jonathan Andic.

Sources consulted by ARA point out that the footprint evidence is not the most important for the investigation, which focuses on other evidence, such as Jonathan Andic's route before the events – the Mossos point out, from the analysis of his mobile phone, that he took an almost identical route four days earlier – and the messages exchanged between father and son.

This Tuesday, a round of declarations will begin at the Martorell courts, with interrogations of Jonathan Andic's therapist and sisters, and other people from the Mango environment as witnesses. So far, the therapist has not testified in this case and is considered a key figure because the messages with death content between Jonathan Andic and Isak Andic are framed within a therapy that she was guiding.
