The Barcelona Court releases the mother of the abused baby and keeps the father in prison
The two defenses requested that they could await trial in freedom
BarcelonaThe Barcelona Court has released the mother of the baby allegedly mistreated and sexually assaulted, and keeps the father in provisional prison. Both, who are defending themselves separately, had asked to be able to await trial in freedom.
With Wednesday's decision, the Court is the first judicial instance to make a different decision for each parent. When the facts became known, on March 20, the on-duty judge sent both to provisional prison, and a few days later this was confirmed by the judge investigating the case, the head of Violence against Children and Adolescents.
Now, the Court has made a different decision, after a hearing held last Tuesday in which, for about 40 minutes, it heard the arguments of the defenses, the Public Prosecutor's Office, and the private prosecution of the Generalitat, which is exercising the private prosecution.
The child was discharged after being admitted to Vall d'Hebron Hospital for a month and has been with a foster family since then.
