The court has once again released the man accused of raping his daughter on the street.

The man has accepted the sentence for breaking the victim's restraining order.

BarcelonaThe man arrested for raping his 21-year-old daughter in the middle of the street has been released for the second time. In a fast-track trial in the Lleida court for domestic violence for violating the young woman's restraining order, the man accused of sexual assault with penetration accepted a four-month prison sentence for violating the restraining order, but the sentence was suspended for a two-year period without committing a crime. However, the High Court of Justice of Catalonia (TSJC) has reported that the restraining order remains in effect at a minimum distance of 200 meters from the victim, as well as the prohibition of communication with her by any means.

The rape for which the man was initially arrested took place at 3:00 a.m. on Saturday outside the La Llotja convention center on Avenida de Tortosa in Lleida. Some neighbors called the Guardia Urbana after seeing two people apparently having sex in public. The police approached and identified the two involved. Upon seeing their IDs, the officers discovered they were father and daughter, and the girl explained that her father was forcing her.

According to sources consulted by ARA, both were drunk at the time of the attack, and the Mossos d'Esquadra (Catalan police) are investigating. The detainee's son, the victim's brother, who was only eight years old, was also in the area where the rape took place. But on Monday, the man was released. Neither the Prosecutor's Office nor the victim initially requested that he be imprisoned, although the young woman reportedly stated that it was not the first time her father had sexually assaulted her.

Thus, the court released the man, but with precautionary measures: he could not come within 200 meters of the victim or communicate with her. However, the next day, the man was arrested for the second time after going to the victim's home and breaking the restraining order. He was forced to appear in a fast-track trial, which ended with a plea bargain allowing him to be released.

The couple reports abuse.

Shortly after the second arrest, the man's partner also reported to the Lleida police station that she had allegedly suffered abuse some time ago by the arrested man, according to police sources confirmed to ARA. Now it's up to the judge to decide whether both the sexual assault involving penetration of her daughter and the abuse complaint will be investigated in a single case or in two separate ones.
