The court has once again released the man accused of raping his daughter on the street in Lleida.

BarcelonaThe man arrested for raping his 21-year-old daughter in the middle of the street in Lleida has been released after being arrested for the second time when he broke the restraining order imposed by the court by showing up at the victim's home. Now, however, the Prosecutor's Office will try to force the alleged attacker into provisional detention without bail in two ways, sources from the Public Prosecutor's Office told ARA. First, it will appeal the court's decision and request that the provisional release issued after his arrest for sexual assault be revoked. Second, it will also request that he serve the four-month sentence he accepted for breaking the restraining order imposed on him.

After his arrest on Monday for raping his daughter in the street, the man was arrested again the following day for breaking the restraining order imposed on him. The father appeared before a judge this Wednesday and, in a fast-track trial at the Lleida court for domestic violence, accepted a four-month prison sentence for violating the restraining order. However, the sentence has been suspended on the condition that he does not reoffend within two years. Sources from the Prosecutor's Office indicate that the prosecutor expressly opposed suspending this sentence and has requested that the man serve the four months in prison. Therefore, the Public Prosecutor's Office will appeal the judge's order suspending the sentence.

Despite the suspended sentence, the High Court of Justice of Catalonia (TSJC) clarifies that the precautionary measures issued by the court following the initial arrest for the street sexual assault remain in effect. Thus, the restraining order, requiring him to remain at least 200 meters away from the victim, remains in effect, as well as the prohibition on communicating with her by any means.

The couple reports abuse

Shortly after the second arrest, the man's partner also reported to the Lleida Mossos d'Esquadra police station that she had previously suffered abuse by the arrested man, according to police sources confirmed to ARA. Judicial sources indicate that this complaint will be filed in a separate case from the one investigating the sexual assault involving penetration of his daughter.

The rape for which the man was initially arrested took place at 3:00 a.m. on Saturday outside the La Llotja convention center on Avenida de Tortosa in Lleida. Some neighbors called the Guardia Urbana after seeing two people apparently having sex in public. The police approached and identified the two involved. Upon seeing their IDs, the officers discovered they were father and daughter, and the girl explained that her father was forcing her.

According to sources consulted by ARA, both were drunk at the time of the assault, and the Mossos d'Esquadra (Catalan police) are investigating the incident. The detainee's son, the victim's brother, who was only eight years old, was also present in the area where the rape took place. However, the man was released on Monday. At the time, the Prosecutor's Office did not request that the man be sent to prison, although the daughter reportedly stated that it was not the first time her father had sexually assaulted her.
