Junts froze the investigation into two "harassment" complaints against Comín despite the European Parliament's resolution

The party is standing shoulder to shoulder with the MEP, to whom it handed over evidence presented by the alleged victims.

Brussels/BarcelonaThe Junts Guarantees Commission decided on February 2nd to freeze the internal investigation into two complaints it received against Toni Comín for "psychological, sexual, and physical harassment," according to an internal party report obtained by ARA. The body has opted to shelve the two cases, for at least four months, despite being aware of the European Parliament's resolution upholding the complaint of psychological and sexual harassment filed in the parliament against the former Catalan Health Minister by a former assistant. Furthermore, as confirmed to ARA by various Junts sources, the party provided the MEP with the complaint filed by the alleged victims and the "accompanying documentation," such as "the written statements in which each of them explains the events," as well as the confidential European Parliament resolution.

The Junts party argues that the process has been halted due to a "jurisdictional issue" and considers the "possible disciplinary proceedings" against Comín in the European Parliament to be "preferential" over the party's own internal investigation, which was opened on October 24, 2025. However, the proceedings in the European Parliament were closed last September: they could only be reopened, and the European Parliament could only impose a sanction on the former Catalan Minister of Health, if he wins a seat and receives a new complaint, according to MEP sources speaking to this newspaper.

Furthermore, regarding the other Junts advisor, she has only filed an internal complaint with the party and not with the European Parliament. In this case, several Junts sources explained to ARA that the party employee was the victim of a physical assault by Comín during a tense moment on election night of the Catalan elections on May 12, 2024. The report states that the two complainants accuse Comín of employing a "delaying tactic" and request that the jurisdictional conflict between the Guarantees Committee and the European Parliament be declared "nonexistent," as well as that the disciplinary proceedings be "reprimanded" and that "precautionary measures be adopted" against the former minister. The two alleged victims are also demanding the "immediate resignation" of the former regional minister from "all his positions," that the existence of harassment be "acknowledged," and that Comín be required to issue a public apology "through a brief, sober, and direct statement, without justifications, minimization, or exculpatory arguments." So far, neither the Junts leadership, nor Comín, nor the complainants have commented on ARA's inquiries.

The Commission of Guarantees rejects all petitions

None of these requests have been accepted by the Guarantees Commission, led by Josep Pagès, a member of parliament for the Catalan branch of the ruling party. The report acknowledges that, as of today, "activating the European Parliament's anti-harassment procedure is only a hypothesis" because Comín does not yet hold the seat. However, the body of the party chaired by Carles Puigdemont believes that the ruling expected from the Court of Justice of the European Union (CJEU) in the coming months could "endorse the amnesty law" and, therefore, allow the former regional minister to become a full-fledged MEP. "The possibility of obtaining the seat, although hypothetical, is not entirely improbable," the text notes. However, the same Guarantees Commission admits that this wait "cannot be unlimited" and, therefore, sets a maximum period of four to eight months for suspending the internal investigation. Thus, the body decided to keep the investigation suspended for four months after the parties received notification of its suspension in early February, but with the "possibility of an extension." Regarding the precautionary measures, the Guarantees Commission considers them "not sufficiently justified" and points out that the reported conduct "has not been repeated since June 2024." Along the same lines, the report argues that "currently there is no type of employment, personal, or political relationship, nor any physical proximity," between the complainants and Comín.

Regarding the request to force his resignation and compel him to apologize, the regional government body points out that "this is not the appropriate procedural moment to address the substance of the matter under disciplinary proceedings," but rather it is necessary to "resolve the jurisdictional issue of whether the potential proceedings before the European Parliament should take precedence over the internal proceedings." The Guarantees Commission gives the same response when the complainants request that the events be "classified as very serious" because Comín's conduct "fits the description of behaviors constituting very serious offenses" according to the party's regulations, such as "attacks against human rights and the dignity of individuals, and acts or support for violent, insulting, or humiliating behavior." The provincial council also fails to consider that Comín, according to the complainants, "invoked, implicitly or explicitly, his status as an exile or political prisoner as a justification, mitigating factor, or exoneration for his actions." Finally, the report concludes by stating that the "resolution" is not "subject to appeal," both for the alleged victims and for Comín.
