Amnesty for Marta Rovira. The Barcelona Court has applied the law to the former secretary general of ERC, who still had an open case for disobedience following the 1-O, according to the court resolution to which ARA has had access. This is the case that the Supreme Court opened against her in 2018 and which led her to go into exile in Switzerland. At that time, the high court accused her of a crime of rebellion, which became sedition starting in 2019 and, after the reform of the Penal Code, was reduced to a crime of disobedience. In May of this year, the Supreme Court decided that it was not competent to resolve this case and transferred it to the Barcelona Court, which closed it this Tuesday by applying the amnesty law. Rovira faced a possible sentence of disqualification, but was no longer at risk of being sentenced to prison.

The ruling of the CJEU on the amnesty law has caused a ripple effect. In recent days, the Supreme Court has rushed to close six cases that were on its table and had been pending for months. However, despite this sudden awakening, the fourteen people who have benefited from the penal oblivion law do not – strictly speaking – have anything to do with Luxembourg's endorsement. It was a filter that the high court implicitly set and which has ended up being the pretext for keeping all these cases frozen for nine months, given that last October the Constitutional Court had explicitly given the green light to apply the law.

After October 1, the independence movement entered a phase of disorientation and strategic revision. This was also true for the Left. Repression hit the party hard, forcing it to reposition its internal components and design a new political strategy: the Republicans were the first to open dialogue with the State. However, in the midst of this process, mistrust and internal disputes grew to the point of bringing down the tandem that had led the party for more than ten years: Oriol Junqueras and Marta Rovira. All this erupted after the defeat of the March 12 elections. The conflict that had been brewing for months, secretly, exploded just hours after the defeat in the 12-M elections. Months ago – in some cases years – the research group Citizen Lab, from the University of Toronto, contacted dozens of individuals linked to the Independence bid to see if they could analyse their mobile phones. They wanted to check whether they had been victims of Pegasus, a virus devised by Israeli company NSO only sold to states which could be used to access all information on a cell phone can be obtained without the affected party knowing about it. The results came back positive: their phones had been infected, yet they had all been acting as if they were being spied on for some time. As many as nine victims explained their experience to ARA.

Faced with the possibility that JxCat could postpone the investiture debate if there is no agreement to form Government, ERC has taken advantage of the act of commemoration of the 90th anniversary of the party to pressure the party of Carles Puigdemont and also the CUP.
