The court confirms that Carlos Herrera failed to pay two million euros in taxes through a "business network."
The National Court dismisses the appeal of the radio host, who allegedly used a "network of companies" to evade taxes.
BarcelonaThe National Court confirms that radio host Carlos Herrera paid more than two million euros in taxes incorrectly in the years 2006 and 2007. The ruling, to which the court has had access, The Confidential, The National Court dismisses the journalist's appeal and states that during those years, Herrera allegedly used a "business network" to invoice his contributions to the media, saving himself up to €2,115,670.29 in taxes. According to the Tax Agency, through these companies, Herrera allegedly paid corporate tax on the contributions, and not the corresponding personal income tax bracket, thus avoiding paying more. The National Court considers that this procedure would not be correct because the income would actually have been the result of the journalist's "personal" work, and that his companies could not contribute anything. According to the Court, his company "acted as a mere collection agent," when the work would not be "attributable to it but to the partner, since it was the one who actually carried out the work invoiced to the clients."
The new ruling confirms the Supreme Court's ruling, which in 2023 concluded that Herrera used four different companies to channel his income. At the center of the entire operation, the court has placed the company La Rehos, of which Herrera owned 94% of the share capital. Through this company, the broadcaster allegedly invoiced his contributions.
The broadcaster Herrera on COPE, can still appeal to the Supreme Court.
