The Barcelona Provincial Court accepted an appeal from his defense to overturn the decision of the investigating judge in the case, who He was sent to pretrial detention on November 28.The judges, like the Sabadell judge investigating the case, believe there is sufficient evidence against Laiglesia, but they think that after 25 years it is unlikely he will attempt to evade justice and do not see it as necessary for him to await trial in prison. He will be able to do so on provisional release, but without his passport – he is prohibited from leaving the country – and with the obligation to appear in court once a month.

Three witnesses in the case investigating the murder of Helena Jubany in 2001 have reiterated their statements before the judge, which disprove the version with which the main suspect in the crime, Santi Laiglesia, has exonerated himself until now. The three had already testified in court in 2021During the period the case was open between July 2020 and March 2021, when it was again shelved. In fact, his appointments have been repeated to avoid the possibility that they might be considered invalid for having been made during this impasse, and they coincide with the day after Laiglesia filed an appeal, which ARA has accessed and with which He is trying to get out of the provisional jail, where he has been for 12 days.According to sources present at the deposition, the three witnesses reiterated their accounts, which contradict the suspect's version of events. One of the points they corroborated is that Laiglesia lived in the building where Jubany's body was found, after she was thrown from the roof into an interior courtyard, naked and with burns on different parts of her body. Laiglesia's then-partner, Montse Careta, lived in that apartment building. She was the first person arrested for the crime and committed suicide in Wad-Ras prison in 2002. Laiglesia has always maintained that he didn't live there, but only spent some nights there, and that he was there that night. However, on Wednesday, two witnesses explained the opposite. On one hand, a relative of the building's owner, who worked in administration and maintenance, explained to the judge that Careta had asked some time ago to add Laiglesia to the rental agreement. The change was ultimately not made, according to the witness, to avoid the paperwork. On the other hand, one of Montse Careta's sisters also corroborated that Laiglesia lived in the building. According to sources present at the deposition, the witness explained that she was very close to her sister and visited her frequently, to the point that she had a set of keys because she spent many nights at the apartment. This changed, the witness explained, months before the crime, when Laiglesia and Careta reconciled, because he stipulated that his sister not be in the apartment they shared so often.

With the main suspect in pretrial detention for just a week, the investigation into the 2001 murder of Helena Jubany has reached its final stages, and the prosecution is seeking to exhaust all options for gathering evidence before the case goes to trial. The judge in Sabadell presiding over the case has ordered, at the request of the Public Prosecutor's Office, that the police conduct a handwriting analysis of Santi Laiglesia and compare it with the anonymous messages Jubany received before her death. Throughout the investigation, these anonymous messages have been the subject of expert and philological reports comparing the handwriting and language used with virtually all the individuals suspected of the crime. In fact, these tests had already linked the messages to the other person under investigation in the case, Xavier Jiménez. Until now, however, none of these tests had been carried out on Laiglesia, whom the family considers the prime suspect in Jubany's murder. Now, he will be transferred from prison to the courthouse so that handwriting experts from the National Police can take samples of his writing and conduct a comparative analysis. The investigating judge has also summoned four witnesses to court next Wednesday to repeat their statements. These four had already testified after the judicial investigation was reopened in July 2020 and before it was shelved again in March 2021. Since their testimonies were taken during this period of inactivity, the prosecution believes they could now be considered invalid and has asked the judge to order them to be repeated. Meanwhile, the Jubany family has asked the judge to summon two more witnesses to testify. These are the owner and an employee of the pharmacy where the benzodiazepines found in the victim's blood were allegedly purchased. These drugs, according to the investigating judge, left her in a "state of deep sleep or coma" before she was thrown from a rooftop. Their testimonies were scheduled for February 2021, but were never taken because the witnesses contracted coronavirus, and the case was subsequently closed.

The judge presiding over the case ordered the provisional detention of the family's main suspect, criminal lawyer Santi Laiglesia, an acquaintance of the victim and the partner of another acquaintance, Montse Careta. Careta was initially the prime suspect, as it was from the rooftop of her house that the victim's body was thrown. Jubany's clothing, which has been key to the investigation, was found folded on the rooftop. She was in a semi-coma due to the ingestion of benzodiazepines, and her body was found naked, burned, and disfigured from the fall. Careta, however, committed suicide in prison in 2002 and never ceased to insist on her innocence. Laiglesia and the other person now under investigation in the case, Xavier Jiménez, were initially charged, but ultimately there was insufficient incriminating evidence and the case was dismissed in 2005.

The judge investigating the 2001 murder of Helena Jubany has remanded Santi Laiglesia in custody without bail. The victim's family considers him the prime suspect in the murder. DNA evidence obtained thanks to advances in scientific analysis over the last two decades links Laiglesia to genetic material found on the sweater Jubany was wearing when she was killed. This evidence has been key in strengthening suspicions against him, placing him at the scene of the crime. The investigating judge now maintains that there is "clearly incriminating" evidence against him and that he could flee if released, as well as "pressure or influence" witnesses who will have to testify soon. This Friday's decision paves the way for a trial more than two decades after the murder. A move that, for the Jubany family, represents a "historic turning point" in the case, after having succeeded in 2021 in reopening an investigation that had been shelved in 2005. Helena Jubany's siblings and father waited all morning outside the Sabadell courthouse until they received the news of her imprisonment. The family's lawyer, Benet Salellas, celebrated that "it marks the beginning of breaking the cycle of impunity." Helena Jubany was murdered on December 2, 2001, and her body was thrown from the rooftop into the inner courtyard of a building while she was in a "deep sleep or coma" after ingesting toxic substances, after being undressed and burned. Ending "the imposed code of silence"

The investigating magistrate of Court Number 2 in Sabadell had summoned the main suspect in the case to testify this Friday following the results of DNA tests that point to him. Laiglesia was summoned for 9:30 a.m. and arrived accompanied by his lawyers. Family and friends of Montse Careta, his partner at the time of the crime, were waiting for him at the courthouse entrance. Careta committed suicide in 2002 while in pretrial detention under investigation for the murder. Laiglesia, a lawyer by profession, chose to exercise his right to remain silent and did not answer any questions. Neither from his defense, nor from the prosecution, nor from the investigating magistrate. He also offered no "reasonable explanation," the judge stated in her ruling, as to why traces of his DNA were found on Jubany's clothing. After the hearing, both the Public Prosecutor's Office and the private prosecution representing the family of the murdered librarian requested that the investigating magistrate remand him in custody. "The lack of explanation only serves to incriminate," Salellas stated, while awaiting the magistrate's ruling. Salellas also said they want to end the "code of silence" imposed on those close to the suspects. All those investigated for the crime were Jubany's colleagues in the Sabadell Hiking Club (UES), as were many witnesses in the case. The statute of limitations has expired for those who were never formally investigated. The investigating judge believes that several people were involved in Jubany's death, but they have been excluded from the case for various reasons. Therefore, she believes that if Laiglesia remains free during the final phase of the investigation and the trial preparations, he could use this to "pressure or influence" these witnesses to testify in his favor. This Friday, Laiglesia was transferred to Brians 1 prison in Sant Esteve Sesrovires, where he was admitted before 6:00 p.m.

The judge has therefore summoned Laiglesia for questioning on September 26.
