It was a a dense session today at the Court of Justice of the European Union (CJEU) as it heard the questions raised by Spanish Supreme Court judge Pablo Llarena after the Belgian courts refused the extradition of the former conseller Lluís Puig. Throughout the morning, all parties have been able to present their arguments and the European Commission, as guardian of the treaties and rules of the European Union, has defended the Spanish position. According to the Commission, Belgium should not have assessed whether or not Puig would have a fair trial in Spain when receiving the European arrest warrant, because "there is no systemic problem of rule of law" in Spain.

Former president of the Generalitat and current MEP Carles Puigdemont has chosen October 1 to ask the European courts to restore his parliamentary immunity. The European General Court (EGC) has informed this Friday that Puigdemont's defence has formally requested provisional measures to regain immunity, as they already warned that they would do after his arrest in Alghero. Puigdemont has an appointment on Monday, October 4 before the judge in Sassari, who ordered his release after the ex president spent a night in prison in Sardinia.

Carles Puigdemont is now out of Bancari prison. After spending the night there and appearing before the judge from the penitentiary centre telematically, the Court of Appeal of Sassari has decided to release the former president, arrested on Thursday at Algher airport. Although his defence has requested a 24-hour postponement of the hearing, Puigdemont has been released without charge. In this way, the leader of Junts has left prison without paying any bail and, according to the head of the former president's office, Josep Lluís Alay, he will have "total freedom of movement" and, therefore, will be able to leave Italy. The magistrate has summoned Puigdemont to testify again on 4 October and then the question of extradition will be discussed.
