This is what, according to Constitutional Court judges Juan Antonio Xiol and Maria Luisa Balaguer, the sentence of 11 and a half years in prison for the former Catalan Parliament Speaker Carme Forcadell causes. Xiol and Balaguer are the two members of the Constitutional Court that wrote a dissenting opinion to the plenary's decision to dismiss the appeal of Forcadell against the Supreme Court's sentence. In fact, they also did so in the appeals of Jordi Cuixart, Jordi Sànchez, Jordi Turull and Josep Rull. As they did in these cases, Forcadell's sentence is also considered "disproportionate". In the situation of the former president, another factor is added to the equation: the right to political representation, which they consider to have been violated.</p>]]></description>

The instructing delegate, Esperanza García, has decided to reject the guarantee the Institut Català de Finances (ICF) put forward to cover the bail of €5.4m imposed in June. Although she demanded that the money be paid urgently, the defendants devised a formula to avoid having to respond with their personal assets and the Government drew up a decree for the ICF to cover the bail. This alternative was endorsed by the Council of Statutory Guarantees and investigated by the Catalan Prosecutor's Office. </p>]]></description>

The ruling considers it accredited that the two agents helped Puigdemont aware that he was under investigation in Spain and that there was a Euro arrest warrant in place, but concludes that the facts cannot be classified as an accessory after the fact crime under Article 541.3 of the Criminal Code, as the lawyers had argued since the arrest of Carlos de Pedro and Xavier Goicoechea in Catalonia by the Spanish police, days after the journey through northern and central Europe. The prosecution had asked for up to a year and a half in prison for each of them, after deciding to reduce the sentence request by half in the final conclusions of the trial held earlier this month at the headquarters of the National High Court in San Fernando de Henares, on the outskirts of Madrid.</p>]]></description>

So ended the speech of the President of Òmnium, Jordi Cuixart, at the 47th Human Rights Council of the UN, based in Geneva, but which this year has been held telematically. Cuixart has had a minute before hundreds of listeners around the world, including ministers, ambassadors and senior UN officials, in which he has charged against an "undemocratic" Spanish state. An attitude, according to Cuixart, that the UN has to correct: he has urged the United Nations to "act so that Spain respects international treaties". This is, in fact, the role of the council in which the President of Òmnium has participated in this Thursday, since it meets periodically to protect human rights and address situations in which they are violated. Specifically, Cuixart has had a voice in the eighteenth act that has been made in the framework of the Human Rights Council, where the special rapporteur on the right to peaceful assembly of the UN, Clement Voulé, has presented his annual report: "Access to justice as an integral element of the protection of the rights to freedom of peaceful assembly and association".</p>]]></description>

"The Constitution includes a time for punishment and a time for concord.
