Political prisoners at Lledoners penitentiary will no longer be under an open prison regime. The same day that the European Parliament withdrew ex president Carles Puigdemont immunity and former Catalan ministers Toni Comín and Clara Ponsatí's immunity, the judge of penitentiary surveillance has also decided to overturn the regime of semi-freedom enjoyed by the pro-independence leaders since the end of January. According to sources close to the prisoners, the judge has decided to overturn the third degree as demanded by the Prosecutor's Office. Although they have not yet received official communication, in all probability this evening the prisoners will have to return to prison and will no longer be able to leave daily as they did until now or spend weekends at home. Yes they will be able, however, to benefit from the different permits to which they are entitled to for having served a quarter of the sentence.

The prosecution has filed an appeal to the Spanish Supreme Court against the precautionary maintenance of an open prison regime for Dolors Bassa and Carme Forcadell. It thus appeals to the court that originally ruled on the matter the decision by the Court of penitentiary surveillance number 1, which rejected the precautionary measures demanded by the Public Prosecutor's Office while it studies the merits of the appeal. The Prosecutor's Office stresses that the organic law of the judiciary establishes the suspensive nature of the appeal in matters of classification when it comes to those convicted of serious crimes who can be subsequently released from prison.

The Generalitat moved the nine political prisoners to an open prison regime at the beginning of the electoral campaign and the Public Prosecutor's Office has just appealed against this measure today, the day straight after the elections. Two weeks have passed without news from the Public Prosecutor's Office, which has finally decided to present an appeal to the penitentiary surveillance courts, which are also being asked to suspend the open prison regime immediately until a definitive judicial decision is made.

The political prisoners are leaving prison again today, after yesterday they received the open prison regime again. It was granted by the Ministry of Justice of the Generalitat, and it will allow them to go out on the streets during the day but will have to return at night to sleep in prison from Monday to Thursday. The only one who will not leave prison is president Forcadell, because there is an outbreak of coronavirus in the prison of Wad-Ras.
